Affiliate Program Terms

These Affiliate Program Terms (the "Affiliate Terms") govern participation in the Travel with Tyla affiliate program (the "Program"). In these Affiliate Terms, "we", "us" and "our" refer to Travel with Tyla, and "you" and "Affiliate" refer to anyone who applies to or takes part in the Program. By registering for the Program, you agree to these Affiliate Terms, our Terms of Service and our Privacy Policy. If there is a conflict between these Affiliate Terms and our Terms of Service concerning the Program, these Affiliate Terms apply.

1. The Program

The Program allows approved Affiliates to promote our products and earn commission on qualifying purchases they refer through a unique affiliate link or referral code. The Program is administered using a third-party app, ReferrLy, which provides your affiliate dashboard, tracks referrals and records commission.

2. Eligibility and approval

To take part you must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. You must provide accurate and complete registration and payout information and keep it up to date. We may approve or decline any application, and may suspend or remove any Affiliate at any time, at our sole discretion.

3. Relationship

You are an independent contractor. Nothing in these Affiliate Terms creates a partnership, joint venture, employment, franchise or agency relationship between you and us. You may not make any statement, promise or commitment on our behalf. You are responsible for your own costs and for any taxes, social contributions or registrations that apply to the commission you receive.

4. Commission

Commission rates and terms are agreed individually with each Affiliate. Your commission rate, the tracking period for referrals, and any other terms specific to you will be confirmed to you in writing (for example by email) and/or shown in your affiliate dashboard. Unless we agree otherwise in writing, the rate that applies to a purchase is the rate in effect for you at the time the purchase is made.

A purchase qualifies for commission only if it is made by a genuine customer through your affiliate link or referral code and is tracked and attributed to you by our affiliate system within the applicable tracking period. If more than one Affiliate refers the same customer, our tracking records decide which Affiliate is credited. We may change your commission rate or terms by giving you notice; changes apply only to purchases made after the notice takes effect.

5. Refunds, cancellations and invalid orders

No commission is earned on orders that are cancelled, refunded, returned, charged back or not paid in full, or on orders we reasonably believe are fraudulent, self-referred or generated in breach of these Affiliate Terms. If commission has already been paid on such an order, we may deduct it from future payments or ask you to repay it.

6. Payment

Commission is paid using the payout method and on the schedule agreed with you or shown in your affiliate dashboard. Payments may be subject to a minimum payout amount and to a holding period so that returns and refunds can be processed first. You are responsible for providing correct payout details; we are not responsible for payments sent to details you provided that turn out to be incorrect. We may ask you for information needed to meet our tax or legal obligations before making a payment.

7. Prohibited practices

You must not:

refer purchases made by yourself, members of your household, or accounts you control;
send unsolicited messages, spam or bulk messages promoting us;
run any paid advertising for Travel with Tyla or our products, or use our brand name in domains or social media handles, as described in section 8;
use cookie stuffing, forced clicks, misleading redirects, incentivised clicks, bots or any other method that artificially generates referrals;
post your referral code or links on coupon, voucher or deal websites unless we have given written permission;
make false, misleading, defamatory or disparaging statements about us or our products, as described in section 9; or
promote us on websites or channels containing unlawful, hateful, violent, sexually explicit or otherwise inappropriate content.

8. No advertising on our behalf

Affiliates may promote our products only through their own organic (unpaid) content and channels. You must not run, buy or boost any paid advertising on behalf of Travel with Tyla, including paid search ads, paid social media ads, boosted or promoted posts, sponsored placements, display or banner ads, influencer whitelisting or any other paid media that promotes Travel with Tyla, our products or your affiliate link or referral code, unless we have given you specific prior written permission. In particular, you must not bid on our brand name "Travel with Tyla" or any confusingly similar terms as keywords, and you must not register domain names, social media handles, pages or accounts that contain our brand name.

You must never present yourself as Travel with Tyla, as our employee or official representative, or as acting on our behalf, and you must not create advertising, accounts or content that could reasonably make people believe it comes from us. Any permission we give for paid advertising applies only to the campaign we approve, can be withdrawn at any time, and does not entitle you to reimbursement of advertising costs unless we agree otherwise in writing.

9. Protecting our reputation

While you participate in the Program, you must not make, publish or share any statement, review, comment or content, online or offline, that defames, disparages or is otherwise negative about Travel with Tyla, our products, our services or our team. This includes posts, comments, reviews, videos, stories and messages on social media, review platforms, forums and websites.

If you have a concern, complaint or problem with Travel with Tyla, our products or the Program, you must raise it with us directly and privately by emailing info@travelwithtyla.com, and give us a reasonable opportunity to respond and resolve it. You must not raise it publicly online.

Breach of this section is a serious breach of these Affiliate Terms and may result in immediate removal from the Program and forfeiture of unpaid commission under section 13. Nothing in this section prevents you from reporting a matter to a regulator, law enforcement or other public authority, or from making any statement you are legally required or entitled to make and that cannot lawfully be restricted by contract.

10. Disclosure of the affiliate relationship

You must clearly and conspicuously disclose your relationship with us whenever you promote our products, for example by labelling content with "ad", "affiliate link" or "I earn commission from purchases made through this link". The disclosure must appear close to the promotion and be easy to notice, and must not be hidden only in a profile, a list of hashtags or a "see more" section. You must comply with all applicable advertising and consumer protection laws and with the rules of each platform you use, including any branded or paid partnership labelling tools those platforms provide.

11. Use of our brand and content

We grant you a limited, non-exclusive, non-transferable and revocable licence to use our name, logos, product images and promotional materials that we make available to you, solely to promote our products under the Program and in line with any brand guidelines we provide. You may not alter our logos or materials in a misleading way. This licence ends automatically when your participation ends, and you must then stop using our brand and remove our materials where reasonably possible.

12. Personal information

We collect and use your personal information, and the information of customers you refer, as described in our Privacy Policy. You must comply with all applicable privacy and data protection laws in your promotional activities and you are responsible for your own privacy practices. You must not collect personal information from customers on our behalf.

13. Termination

Either you or we may end your participation in the Program at any time by notice. If your participation is ended because you breached these Affiliate Terms, any unpaid commission is forfeited. Otherwise, commission earned on qualifying purchases made before termination will be paid in line with the normal payment terms, once any applicable holding period has passed.

14. Liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss of profits or opportunity, arising from the Program, including from tracking errors or interruptions to the affiliate dashboard. Our total liability to you in connection with the Program is limited to the unpaid commission properly owed to you. You agree to indemnify us against claims arising from your promotional activities or your breach of these Affiliate Terms. Nothing in these Affiliate Terms limits any liability that cannot be limited by law.

15. Changes to the Program and these Affiliate Terms

We may change, suspend or end the Program, or update these Affiliate Terms, at any time. We will give Affiliates reasonable notice of material changes by email or through the affiliate dashboard. If you keep participating after a change takes effect, you accept the updated Affiliate Terms.

16. General

These Affiliate Terms, together with any individual commission terms agreed with you in writing, our Terms of Service and our Privacy Policy, form the entire agreement between you and us about the Program. The governing law and dispute provisions in our Terms of Service also apply to these Affiliate Terms. If any provision is found to be unenforceable, the rest remain in effect. You may not assign your rights under these Affiliate Terms without our written consent.
